Unless otherwise specified, all materials appearing on this site, including the text, site design, logos, graphics, icons, and images, as well as the selection, assembly and arrangement thereof, are the sole property of Bloom2Bloom. You may use the content of this site only for the purpose of shopping on this site or placing an order on this site and for no other purpose. All names, logos, service marks, and trademarks appearing in this Website, including the trademarks, service marks, brand identities, characters, trade names, graphics, designs, copyrights, trade dress, and all other intellectual property ("Content"), except as otherwise noted, are protected intellectual property of, or used with permission or under license by Bloom2Bloom and its subsidiaries and affiliates. This includes the entire Content of the Website, protected as a collective work. When collecting your personal information, we will use it only for the use specified and will not sell your information to a third party.
Shipping Policy
We currently ship our bouquets to every ZIP Code in California and the major metropolitan areas of Arizona, Nevada, Oregon, Washington, Utah and Colorado.
Shipping Time --
We work our hardest to fill the order and ship out the same day the order is placed, however most orders placed after 1:30pm Pacific it will go out the following day.
Most orders for our flower products received before 1:30 PM Pacific Monday - Friday will ship the same day, provided the product ordered is in stock. Saturday delivery offered for select areas only. Additional surcharges may apply to Saturday delivery days. Orders are not processed or shipped on Saturday or Sunday as a result Monday deliveries are not available at this time.
We cannot guarantee when an order will arrive. Consider any shipping or transit time offered to you by Bloom2Bloom only as an estimate. We encourage you to order in a timely fashion to avoid delays caused by shipping or product availability.
Out-of-Stock Products
We will ship your product as it becomes available. However, there may be times when the product you have ordered is out-of-stock which will delay fulfilling your order. We will keep you informed of any products that you have ordered that are out-of-stock and unavailable for immediate shipment.
Shipping and Delivery
Bloom2Bloom, in conjunction with our service providers, will attempt to deliver a product on the requested delivery day. You acknowledge that requested delivery dates are non-binding estimates only and that you have no claim against us for any delays or early deliveries. Our service providers do not telephone prior to delivering packages, and we cannot guarantee the time of delivery. All products are deemed accepted upon our delivery of the product to you or your designated recipient’s address.
Bloom2Bloom is not responsible for:
Flowers delivered to incorrect addresses supplied by the sender.
Unsuccessful deliveries arising from the recipient not being present at time of delivery at the address supplied by the sender.
Decreased product quality due to an incorrect delivery address supplied by the sender, or a re-route requested by the sender.
Product quality problems caused by improper handling by the recipient.
Taxes
Each customer shall be solely responsible for all sales taxes, or other applicable taxes on all orders shipped.
Warranty Disclaimer and Limitation of Liability
THE SITE AND THE CONTENT ARE PROVIDED ‘AS IS’ AND WITHOUT ANY WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, IMPLIED WARRANTIES OF SATISFACTORY QUALITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT PERMITTED BY LAW. Dispute Resolution
Applicable Law: The Terms and Conditions and any legal action against us shall be governed in all respects by the laws of the State of California and as those laws apply to agreements entered into and to be performed entirely within California.
Indemnity
By using any one of our Sites, you agree to indemnify and hold Bloom2Bloom, its subsidiaries, affiliates, officers, agents and other partners and employees, harmless from any loss, liability, claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your use of such Site, including providing a link to another site or any User Content or your violation of these Terms and Conditions.
Severability
If any provision of the Terms and Conditions is held to be invalid, void or unenforceable, the remaining provisions shall nevertheless continue in full force and effect and the invalid, void, or unenforceable provision shall be deemed modified so that it is valid and enforceable to the maximum extent permitted by the law.
Other General Provisions
Section titles in the Terms and Conditions are for convenience and do not define, limit, or extend any provision of the Terms and Conditions. As used herein, the term “including” means “including without limitation”. Our failure to enforce any right or provision shall not operate as a waiver of such right or provision. Neither party is the agent or partner of the other party. These Terms and Conditions may not be assigned by you without our prior written consent and any attempted assignment in violation of the foregoing shall be null and void. The terms of these Terms and Conditions shall be binding upon permitted assignees.
